As we discussed in our May 2, 2019, blog, “Not Quite the End of the Road on the EEO-1 Reporting Litigation,” EEO-1 Component 2 data (for calendar years 2017 AND 2018 only) is due by September 30, 2019.
In order to facilitate the submission of this data, EEOC committed to the creation of an online data submission portal by July 15.
The EEO-1 regulatory requirements apply to employers with 100 or more employees, or to employers with 50 or more employees and at least $50,000 in federal government contracts. Smaller employers, therefore, are not required to file the EEO-1 report.
The data submission portal is nearly ready, and a static page, along with a wealth of information in the form of FAQs, is now available. The FAQ page includes information on filing requirements, summary compensation data, hours worked and confidentiality of data, among other topics.
In addition, EEOC recently filed a Notice with the United States District Court for the District of Columbia with a progress report on its project implantation plan. The Notice set forth a number of completed steps, along with activities that are expected to take place over the next two months. An employer contact plan, which will include notifications by EEOC to employers both with and without portal login information, is already underway. Details are set forth in the following table:
